Presidential Regulation of the Republic of Indonesia Number 109 of 2025, a new milestone in national waste management

Presidential Regulation of the Republic of Indonesia Number 109 of 2025 on Urban Waste Management through the Conversion of Waste into Renewable Energy Using Environmentally Sound Technology entered into force on October 10, 2025. The promulgation of this regulation was driven by Indonesia's escalating waste generation, which surpassed 56 million tons in 2023. Of this total, only approximately 39 percent was adequately managed, while the remaining waste was disposed of through open dumping practices, resulting in significant environmental degradation, pollution, and adverse public health impacts.
Conceptually, the conversion of waste into renewable energy using environmentally friendly technology refers to the processing of waste through specialized machinery and equipment to produce electricity, bioenergy, renewable fuels, and other value-added by-products. This regulation establishes a comprehensive legal framework to address urban waste challenges by promoting waste-to-energy solutions that reduce waste volumes while simultaneously contributing to the achievement of national clean energy and sustainability objectives.
The regulations prioritize implementation in metropolitan regions and major urban centers characterized by high daily waste generation—exceeding 1,000 tons per day—with landfill sites that have reached or exceeded their operational capacity. Under this framework, electricity generated by waste-to-energy power plants (PLTSaL: Pembangkit Listrik Tenaga Sampah) is to be purchased by PT PLN (Persero) at a predetermined tariff for a period of 30 years, without provision for price negotiation or escalation.
In terms of implementation responsibilities, local governments are mandated to provide land for waste management facilities, allocate regional budgetary resources for waste collection and handling, and establish sanitation service fees to support the sustainability of the waste management system.
